PROF. RICHARD REUBEN QUOTED IN ARTICLE ABOUT MEDIATION CONFIDENTIALITY
An article in ADRWorld.com quotes Prof. Richard Reuben criticizing a decision by the New York Court of Appeals, which upheld a subpoena of a mediator. In the July 2 article, “Top New York Court Upholds Subpoena Against Mediator,” Reuben “said the court's holding ‘underscores the depth of the mediation community's problem in New York.’ Not only did the state’'s highest court refuse to find any separate confidentiality protection for the mediator that survives a waiver by the parties, the court explicitly took no position on whether the parties have a mediation privilege under state law.”
