  • How do the Religion Clauses become applicable to the states?
    • If one takes the view that the EC was meant simply to keep the fed. gov’t out of the establishment business (see n. a p. 1727), how could EC ever apply to the States?

    • Are athletic events different from graduation ceremonies, for EC purposes?
  • Elk Grove U.S.D. v. Newdow, p. 1743 (2004): “Under God” in the Pledge of Allegiance – if the majority had gotten to the merits, what result would you expect?
  • EDWARDS V. AGUILLARD, p. 1743 (1987)
    • What regulation, with what purpose?
      • Can this regulation have "a secular purpose"?
      • If there is a dispute as to whether "creation science" has a non-religious scientific value, who should decide that dispute?
    • How does the regulation fare under the other elements of Lemon?
