Title IX Procedures Explained by Professor Trachtenberg

Professor Ben Trachtenberg was recently quoted in a story from the Columbia Daily Tribune about the University of Missouri’s procedures for hearing “cases of professors being accused of sexual discrimination under Title IX,” according to the article.

Under its current policy, the university uses “‘preponderance of evidence’ as the burden of proof,” the article notes. Professor Trachtenberg explained that in such cases, “decision(s) are made in favor of the person the jury or judge believes by at least 50.01 percent.”

Professor Trachtenberg discussed common understandings of this standard of proof as well as his thoughts on its application to sexual discrimination cases in question.
