Professor Trachtenberg joins the campus free speech debate with new article

Professor Ben Trachtenberg joins the campus free speech debate with “Private Universities and the First Amendment,” in the Journal of Dispute Resolution.

He argues that private universities should think carefully before adopting rules imposed by the Constitution on public institutions. Just as some private universities sensibly enact rules concerning religion that would be prohibited at state universities, a one-size-fits-all approach to campus speech may be unwise.

“Concurring Opinions,” a group blog run by several law professors, features the article in a profile that is part of the “First Amendment News” roundup by Prof. Ronald Collins of the University of Washington.
