Missouri Amendment 5 Faces Legal Challenge: Professor Mitchell on KOMU-TV

Professor Mitchell was recently interviewed by KOMU-TV News on whether a non-violent felon should be permitted to possess a firearm. In the case before the Missouri Supreme Court, Marcus Merritt is challenging a statutory restriction that bars all felons from possessing any weapon by relying on Missouri Constitutional Amendment 5. Under the change, the right of citizens to possess weapons shall not be infringed and any restriction of such ownership is subject to strict scrutiny. Moreover, the provision states that only “convicted violent felons” are to be denied firearm possession.
