Professor Peters Interviewed about Medical Malpractice Lawsuit Caps

Professor Philip G. Peters Jr. was recently interviewed for stories from news stations KRCG and KBIA about medical malpractice lawsuit caps. The Missouri state legislature recently voted to put into place limits on the damages that can be awarded in various injury cases. Such limits were “overturned by the state Supreme Court three years ago,” according to the KRCG story.

Professor Peters noted that limits on damages in injury cases “would be unconstitutional because they’d stop jurors from deciding award,” according to the KRCG story. In the KBIA story, Professor Peters said that the “state legislature is attempting to subvert the constitutional right to personal injury litigation by changing the functions by which it operates.”
