Facebook’s New Advertising Feature: Professor Oliveri Comments

Professor Rigel Oliveri, who researches fair housing and online advertising, weighed in on Facebook’s new designation of “Ethnic Affinities,” used when placing housing ads. This allows Facebook advertisers to target certain nationalities and shut out others. Facebook said that it banned advertisers from discriminating against racial groups.

Professor Oliveri noted that the Fair Housing Act prohibits discriminatory advertising. While websites that merely host user-generated content are normally exempt from this part of the law, Facebook’s practices “raises serious legal problems” because Facebook does not merely host the ads, it provides advertisers with the tools to exclude certain races and ethnicities.
