Dean Lyrissa Lidsky will participate in the 35th Annual Jefferson B. Fordham Debate at the University of Utah on November 15. The debate, “Freedom of Speech on College Campuses. Where is the Line Drawn?,” will focus on the First Amendment rights of members of university communities and whether they may be constrained when their speech undermines the educational or research missions of the university.
Dean Lidsky, who is among the nation’s leading First Amendment scholars, will debate Robert Post, Sterling Professor of Law and former dean at Yale Law School. In his forthcoming book, Professor Post scrutinizes the frequently-heard claim that universities are suppressing the First Amendment rights of students, faculty, and invited speakers. Post asserts that speech at universities must be regulated to attain the ends of education. Debates about the proper regulation of campus speech are thus ultimately debates about the nature of education, not about First Amendment rights.
