Professor Trachtenberg Blogs About Free Speech on Campuses

The Washington Post’s “Answer Sheet” blog published an opinion piece by Professor Ben Trachtenberg on campus speech, titled, “Why let the Klan march at a private historically black college? ‘This is not a First Amendment thing, man.'”

The new piece raises arguments similar to those in Professor Trachtenberg’s article in the Journal of Dispute Resolution, “Private Universities and the First Amendment.” In particular, Trachtenberg critiques the position of UC Berkeley Dean Erwin Chemerinsky and UC Irvine Provost Howard Gillman concerning whether private universities should voluntarily adopt the free speech requirements imposed on public universities by First Amendment case law. In their new book, Free Speech on Campus, Chemerinsky and Gillman say, “Yes,” and Trachtenberg says, “Probably not.”
