
Professor Ben Trachtenberg joins the campus free speech debate with “Private Universities and the First Amendment,” in the Journal of Dispute Resolution.
He argues that private universities should think carefully before adopting rules imposed by the Constitution on public institutions. Just as some private universities sensibly enact rules concerning religion that would be prohibited at state universities, a one-size-fits-all approach to campus speech may be unwise.
