At the NAA’s 2016 Fall Education Conference, James Dorsey and Marsha Cox Kelliher participated in a panel discussing workplace issues and trends, collective agreement provisions and the current state of the law in the U.S. and Canada with regard to prohibited discrimination against persons who are or are perceived to be transgender or transsexual.  Kindly they have made their presentation notes available to us for distribution, which we are reproducing below.

Arbitrator Dorsey’s notes provide a brief summary of the law regarding gender identity and expression in Canada, a list of basic terms, a bibliography, and a list of key issues.  Arbitrator Kelliher’s notes provide a description of legal and workplace developments in the US with regard to those same issues.   Arbitrator Kelliher also provides a timeline summarizing these developments.
