This fall, two courts cited Professor Sandra Sperino‘s scholarship. The United States District Court for the Eastern District of Pennsylvania cited her article, Irreconcilable: McDonnell Douglas and Summary Judgment, 102 North Carolina Law Review 459, 484–85 (2024), to discuss a problem with the McDonnell Douglas test. Jones v. National Railroad Passenger Corp., No. CV 24-5558, 2026 WL 2942221, at *7 (E.D. Pa. Sept. 30, 2026).

The United States District Court for the Eastern District of Missouri cited the same article to discuss whether the McDonnell Douglas test is compatible with the summary judgment standard. Clark v. Boeing Co., No. 4:25-CV-00657-MTS, 2026 WL 2568357, at *4 (E.D. Mo. Aug. 31, 2026).
